1. About This Agreement
These Terms & Conditions (“Terms”) apply to schools participating in the YoYo School Pilot Programme. By using the YoYo app with your students, you agree to these Terms on behalf of your institution.
YoYo Technologies Ltd (“YoYo”, “we”, “us”) provides a secure, teacher-led speaking practice app designed to support the modern foreign language (MFL) curriculum, in particular the revised GCSE requirements from 2024 onwards. The app is intended to complement classroom teaching by promoting oral fluency and confidence through independent, structured practice.
2. Definition of the Service
The YoYo app is a digital language tool that allows students to:
- Practise pre-approved speaking phrases or reading texts;
- Receive pronunciation scores and guided feedback;
- Build oral fluency through repetition and self-correction.
The app is used between lessons, typically as homework, under the guidance of the classroom teacher. All content is teacher-selected or approved and is aligned with the school’s curriculum and safeguarding policies.
3. User Eligibility
Access to the YoYo app is restricted to students:
- Enrolled at the participating school;
- Whose names and school email addresses have been shared with YoYo by the school.
Login is via school-issued credentials only. No personal email addresses or identifiers are used.
4. Roles & Responsibilities
School Responsibilities
The school agrees to:
- Provide an accurate class register of all student participants (first name and school email only);
- Assign a reasonable amount of speaking practice on a weekly basis;
- Notify YoYo of any concerns or technical issues encountered by students or teachers.
YoYo Responsibilities
YoYo Technologies Ltd agrees to:
- Provide stable access to the app for all registered student users;
- Respond to any technical support queries within one working day;
- Ensure minimum downtime and communicate any significant disruptions;
- Monitor for misuse and notify schools of any issues related to student conduct or account integrity.
5. Acceptable Use
The app is to be used solely for:
- Completing assigned speaking exercises;
- Practising content pre-approved by the school;
- Improving pronunciation and fluency in line with the MFL curriculum.
Students must not attempt to tamper with, misuse, or access any part of the system beyond their assigned content.
6. Termination of Access
Schools may request the removal of any individual student from the platform at any time. YoYo will action all such requests within one working day.
7. Safeguarding Commitments
The YoYo app is built to support safe, independent learning. It includes the following safeguards:
- No messaging, chat, or peer-to-peer interaction;
- No voice recordings stored;
- No avatars, bios, or personal profiles;
- All content is school-approved and pre-loaded;
- Students can only access exercises assigned by their teacher;
- Teachers can view: Individual student progress, scores, and engagement metrics for their assigned classes, class-level aggregate insights and trends. Individual student performance to inform targeted support
8. Intellectual Property
All app content, technology, and educational materials are the property of YoYo Technologies Ltd. Schools participating in the pilot may access this content for the duration of the programme. No part of the app may be copied, distributed, or adapted without written permission.
Feedback or content suggestions made by teachers may be used by YoYo to improve the app, but do not confer ownership or royalties unless otherwise agreed.
9. Limitation of Liability
During the pilot programme, YoYo Technologies Ltd provides the app on a limited-liability basis. While every effort is made to ensure availability and accuracy, we do not accept liability for:
- Interruptions to service caused by school devices, internet access, or third-party networks;
- Student outcomes or academic performance;
- Incidental or consequential loss resulting from use of the app.
10. Product Updates
YoYo may release updates or improvements to the app during the pilot phase. These will not materially alter the service’s intended purpose and will be communicated to schools as necessary.
11. Data Protection
YoYo Technologies Ltd is the data controller for all student data processed through the app. By participating in the pilot, the school acknowledges this controller relationship and agrees to:
- Provide accurate student information
- Inform parents about the service and data processing
- Direct any data subject requests to YoYo
Full details of our data processing practices are set out in our Privacy Policy (linked or attached), including:
- YoYo as the Data Controller;
- Use of "Legitimate Interests" as the legal basis for processing;
- Collection of pronunciation scores and usage data only;
- No storage of voice recordings or personal identifiers;
- UK/EU-based secure hosting for all stored data. Voice data is processed by SpeechSuper (based in China) for real-time pronunciation scoring only, with immediate deletion and Standard Contractual Clauses in place. No student names or identifiable information accompany voice data sent for processing.
All data remains accessible to the school and can be deleted at their request.The school agrees to inform parents/guardians that:
- Their child will be using the YoYo app for language practice
- YoYo processes limited student data (school email, scores, usage) under a legitimate interests legal basis
- Parents have the right to object to this processing at any time
- Objections should be communicated to the school, who will notify YoYo
If a parent/guardian objects to processing:
- The school must notify YoYo within one working day
- YoYo will cease processing that student's data immediately
- The student will be removed from the platform within one working day
- All existing data will be deleted within 14 days
12. Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from them shall fall under the exclusive jurisdiction of the English courts.
13. Data Breach Notification
In the event of a data breach affecting student data, YoYo will:
- Notify the affected school within 24 hours of becoming aware
- Cooperate with the school to assess the breach and notify authorities as required by GDPR
- Take immediate steps to contain and remediate the breach
